ACCEPTANCE OF TERMS
This End User License Agreement (“Agreement” or “EULA”) is a legal contract between you (“User,” “you,” or “your”) and TheMUV LLC, a New Jersey corporation (“Company,” “we,” “us,” or “our”), regarding your use of The MUV mobile application and related services (“App” or “Service”).
By downloading, installing, accessing, or using The MUV app, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not download, install, access, or use the App.
DESCRIPTION OF SERVICE
The MUV is a comprehensive event platform that connects users, entertainers, and businesses through the following services:
2.1 Core Services
- Event Discovery: Browse, search, and discover events by location, category, and preferences
- Ticket Sales & Purchases: Buy and sell tickets for events through integrated payment systems
- Talent Marketplace: Book entertainers (DJs, musicians, performers) for events
- Event Creation: Create and manage public or private events
- Secure Payments: Escrow-based payment system for talent bookings
- Emergency Features: Safety assistance including emergency contacts and location sharing
- Real-time Services: Notifications, messaging, and attendance tracking
2.2 User Categories
The App serves three distinct user types:
- Regular Users: Event discovery, ticket purchasing, and event creation
- Entertainers: Profile management, gig acceptance, and revenue earning
- Businesses: Event organization, talent hiring, and revenue tracking
ACCOUNT REGISTRATION AND ELIGIBILITY
3.1 Age Requirements
Users must be at least 18 years old to register for a TheMUV account and access general features of the app.
If a venue or event legally requires attendees to be 21 years old (e.g. alcohol-serving venues or by local law), users must meet that age requirement to purchase tickets or gain entry.
TheMUV may require proof of age (government-issued ID or equivalent) as a condition for issuing tickets or admitting entry to such venues.
3.2 Registration Requirements
To access certain features, you must create an account by providing:
For Regular Users:
- First and Last Name
- Valid email address and/or phone number
- Date of birth
- Gender identification
For Entertainers:
- All regular user information
- Stage name or professional name
- Portfolio and service information
- Must be at least 18 years old to set up profiles and accept bookings
For Businesses:
- Business name and description
- Complete business address including city, ZIP code, and country
- Booking contact information (email and phone)
- Tax identification:
- For U.S. businesses: EIN Assignment Letter
- For Bahrain businesses: Commercial Registration (CR) Number

3.3 Account Verification
You agree to provide accurate, current, and complete information. We reserve the right to verify your identity and business information. Tax identification documents are collected solely for business verification and prevention of illicit activities.
User/Business Verification: Typically completed within 24–72 hours of ID submission.
TheMUV reserves the right to request age verification at any time. Users/businesses must provide valid documentation as requested.
Failure to verify age when requested may result in cancellation of bookings, withholding of funds, suspension or termination of account.
3.4 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
USER RESPONSIBILITIES AND CONDUCT
4.1 Acceptable Use
You agree to use the App only for lawful purposes and in accordance with this Agreement. You will not:
- Violate any applicable laws, regulations, or third-party rights
- Post or transmit harmful, offensive, defamatory, or inappropriate content
- Impersonate others or provide false information
- Engage in fraudulent activities or money laundering
- Interfere with the App’s functionality or security
- Use automated systems to access the App without permission
- Collect user information without consent
4.2 Content Standards

- Illegal, harmful, or discriminatory material
- Copyrighted content without permission

- Ensure events comply with local laws and regulations
- Obtain necessary permits and licenses
- Provide accurate event information
- Honor ticket sales and commitments to attendees

4.4 Compliance with Local Laws
Users and businesses acknowledge that laws regarding age vary by country and jurisdiction. It is their responsibility to comply with local laws.
TheMUV is not responsible for violations of age laws outside of its governance; misuse may result in legal liability for the user or business.
PAYMENT TERMS AND FINANCIAL SERVICES
5.1 Payment Processing
The App facilitates payments through third-party payment processors. By using payment services, you agree to the terms of our payment partners.
5.2 Escrow System
For entertainer bookings:
- Payments are held in escrow upon booking confirmation
- Funds released to entertainers 48–72 hours after event completion and customer confirmation, unless a dispute is filed
- Entertainers can withdraw funds through standard transfers (1–3 business days) or instant cash-out (within minutes with 1.5% fee)
- Disputed payments are subject to our dispute resolution process
5.3 Fees and Commissions
Ticket Sales (Business → Customer):
- TheMUV charges a flat 5% + $0.50 per transaction
- Businesses keep 95%+ of ticket revenue
Entertainer Bookings (DJ / Promoter / Performer):
- TheMUV applies a 7% flat commission on completed bookings
Peer-to-Peer Payments (User → User):
- Free for standard transfers (e.g., splitting drinks or tickets)
- Instant cash-out option to a linked debit card for a 1.5% fee (min $0.25, max $15)
Advertising (Optional for Businesses):
- Flexible Pay-Per-Click (PPC) or Pay-Per-View (PPV) campaigns
- Minimum campaign spend: $20
- Optional boosted placements for premium visibility in search and map results
5.4 Refunds and Cancellations
User-Initiated Refunds:
- Allow refunds up to 48 hours before the event unless the event is marked “non-refundable” by the organizer
Organizer Cancellations:
- If an event is canceled, businesses must notify users immediately, and refunds must be issued within 5–7 business days
No-Show Policy:
- Tickets are non-refundable after the event begins
Entertainer Booking Cancellations:
- Entertainers must give at least 7 days’ notice or face penalties (e.g., partial refund to client, lowered rating)
Refund for Canceled Ads:
- Refunds for unused ad spend processed within 7 business days
5.5 Tax Responsibilities
Users are responsible for all applicable taxes related to their transactions. The Company may report payments to tax authorities as required by law.
INTELLECTUAL PROPERTY RIGHTS
6.1 Company IP
The App, including all software, designs, text, graphics, and trademarks, is owned by the Company and protected by intellectual property laws.
6.2 User Content License
By uploading content, you grant the Company a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and distribute your content for App operation and promotion.
6.3 Entertainer Portfolio Rights
Entertainers retain ownership of their portfolio content but grant limited licensing rights for platform display and promotion.
6.4 DMCA Compliance

PRIVACY AND DATA PROTECTION
7.1 Data Collection and Use
Your privacy is governed by our Privacy Policy, which is incorporated into this Agreement.
7.2 Location Services
The App collects location data for:
- Event discovery and recommendations
- Attendance verification
- Emergency assistance features
- Navigation and ride-sharing integration
7.3 Emergency Data Sharing
During emergency situations, your location and contact information may be shared with:
- Your designated emergency contacts
- Emergency services
- Ride-sharing partners
- Event organizers or venue security
7.4 Data Retention

SAFETY AND EMERGENCY FEATURES

Emergency location sharing is provided as-is. We cannot guarantee accuracy or availability of location services.
8.3 Ride-Sharing Integration
Third-party ride-sharing services are independent of The MUV. We are not responsible for ride-sharing service quality, safety, or availability.
8.4 Event Safety
Users attend events at their own risk. Event organizers are responsible for venue safety and security measures.
DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 Service Disclaimer
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 Third-Party Services
We are not responsible for third-party services, including payment processors, ride-sharing services, or venue operations.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO [INSERT LIABILITY CAP OR “THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM”]. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

- Entertainer performance quality
- Personal injury or property damage at events
DISPUTE RESOLUTION
10.1 Internal Dispute Process
Platform disputes (payment, service quality, cancellations) are resolved through our internal mediation process:
- Filing a Dispute: Users or businesses must file within 7 days of the event or transaction
- Resolution Period: TheMUV investigates and resolves within 14 business days
- Funds During Dispute: Payments are held in escrow until resolution
- Both parties may present evidence and arguments
- Admin team makes final decisions on dispute resolution
- Decisions may include refunds, payment releases, or account actions
10.2 Legal Disputes
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to this Agreement or the use of the Application shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, United States. By using the Application, all users and participating businesses consent to the personal jurisdiction and venue of such courts.
10.3 Arbitration

ACCOUNT TERMINATION
11.1 Termination by User

- Fraudulent or illegal activities
- Non-payment of fees
- Repeated policy violations
- Safety concerns
Suspicious Activity Review: TheMUV may temporarily freeze accounts for up to 14 days pending investigation.
11.3 Effect of Termination
Upon termination:
- Access to the App is immediately revoked
- Pending payments may be processed or refunded per our policies

MODIFICATIONS TO THIS AGREEMENT
12.1 Right to Modify

We will notify users of material changes through:
- In-app notifications
- Email notifications
- App store update notes

GENERAL PROVISIONS
13.1 Governing Law
This Agreement is governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles.
13.2 Severability
If any provision is found unenforceable, the remainder of the Agreement remains in effect.
13.3 Entire Agreement
This Agreement, together with our Privacy Policy and any referenced policies, constitutes the entire agreement between you and the Company.
13.4 Assignment
You may not assign this Agreement. We may assign our rights and obligations without notice.
13.5 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control.
INTERNATIONAL USERS
14.1 Supported Regions
TheMUV is intended for global use and may be accessed from various jurisdictions worldwide.
14.2 Local Laws
Users and businesses outside of the United States are responsible for ensuring that their access to and use of the Application complies with all local laws, regulations, and licensing requirements applicable in their country of residence or operation.
TheMUV makes no representation that the Application or its content is appropriate or available for use in all locations. Accessing the Application from territories where its use is illegal or restricted is strictly prohibited.
Users accessing or using the Application from outside the United States acknowledge and agree that they are responsible for complying with the laws of their respective jurisdictions, provided that such use does not conflict with U.S. law.
By using the Application internationally, users agree that they will not access or use the Application in any manner that would cause TheMUV, its partners, or affiliates to violate the laws of any jurisdiction.
14.3 Currency and Exchange
All transactions conducted through the Application shall be processed in U.S. dollars (USD) unless otherwise specified. Users acknowledge that currency conversion fees, international taxes, and bank charges may apply, and such fees are the sole responsibility of the user or business.
